Hardship claim refused By HSBC..Please help!!

I phoned HSBC today and ran down the expenditure form with one of thier opo's. They already had a breakdown of my figures fron the CCCS, which by all accounts did not look terribly impressive in order for them to give me anything other than a"NO!" on the hardship claim. They said: "Your paying the Mortgage, your in a debt management plan, your paying the bills, so your not in Hardship". I have just defaulted twice on my car finance over the last two months due to the New A&L account being set-up and the Bank basically K-naking up the direct debits -this led to the defaults on the car finance. We sold the car privately ,naivly thinking it was ours to sell only to recieve a visit from the finance company informing us that during a check into the finance they had seen that we had against the sale agreement we had sold the car.the guy we sold the car to wants his money back and we don't have it and he like us is fearing the reposession of the car, were now awaiting the car finance company decision as it has been reffered to thier head office. My husband is working 55 hours a week in order to maintain basic living conditions as he rather stupidly did not drop his hours before thre DMP, but this is a serious strain on family life.

What do i do next??

  • P.S. i'm awaiting the car finance companies decision and this was discussed with the bank re the hardship claim. If the Finance company decide to call in the debt could i go back to the Bnak with the Hardship case resting on the Car finanace disaster??
