Where do I go from here?

Hey everybody,
Would anyone be kind enough to give me some guidance into where I go now with my bank fine claim. I am with Barclays, claiming £656 in fines which goes from May 03 to May 09. I sent my letter asking for the money to be returned 2 weeks ago and this has been recieved by barclays. I recieved a letter from Barclays this morning stating they will only be looking into refunding my fine money from August last year.......this could take 8 weeks. The rest of the money before August last year will be looked at after the court case has been finalised.
Do I just do what they say and wait for the court case to finish, or can I go to the FOS? Any advice would be greatly appreciated.

Firstly why are you not claiming from July 2001?(unless your account was opened from that date. The clock stopped on 27th July 2007 on the 6 year rule so its 6 years from that date).
What happened in August 2008? Did you lose a job, have overtime cut?0 -
Thanks for the reply. I didnt know I could go back that far. I thought it was 6 years from the date I put the complaint in. Ah man. I have not got a clue why barclays are only looking into fines from Aug 2008 for now until the court case is up, to me there is no reason at all why they would. I just assumed from what they were telling me in the letter that it is normal procedure? They havent said I cant claim from May 03 to May 09. All that has been said is that I will basically have two cases. One starting Aug 08 till present and then when the court case ends I can get the remainder....May 03 till Aug 08? Sorry to confuse you! But I just havent got a clue where to go next. Whether to go to the FOS or ring Barclays and find out what this all means and then send another letter to them asking for the money again?

Danny, Barclays are the ones that are the odd ones to be honest. They appear to be looking at financial hardship and bank charges up to August 2008 when they introduced the Reserve Useage Fees which are in limbo since they are outside the waiver, inside the OFT test case and are looked at within the banking code remit.
Firstly, get the list of charges from July 2001. Then, add up the charges and send them the letter plus their income and expenditure form.

I understand what you are saying completely, but I dont mean this in any disrespect at all, but it took me so long to get the statements for the last 6 years that I have already, and I am happy going for what I have owed to me (£656). I just dont want to confuse the situation even more! I sent them my letter and list of charges to them....but am just confused on what to do at this stage. So shall I just wait this out now, or take things further?

Danny, it takes one letter to Barclays and you say, I received statements from May 2003 to May 2009 but I am entitled to statements back to July 2001 under the FSA waiver on bank charges point 13.5. Waiver is on my signature btw.
If they have acknowledged then its a sit and wait then.0
