Bank Bacs payment rights

hello guys,

could anybody tell me how I can obtain my money back from a seller which has not shipped the goods ?

Unfortunatley I foolishly paid somebody via Bacs £120 and now have nothing to show for it and the email communication has stopped.

I have been in touch with my Bank but as this is a personal transaction they will not get involved :mad:

should I report this as fraud or is there a better way to go ?

I am fuming and would like to here your thoughts or advice please

    you need really to via the police/small claims
    as you say very foolish.BACS is just like giving someone cash on the street and trusting them to come back with goods
  • for some reason I thought that as it was an electronic transfer, all is documented if something goes wrong..

    what I have learnt is that the Banks do not want to know especially if you are an individual and not a business.

    If you are quite sure that the other person has appropriated your money without ever intending to supply you with any goods and has done a bunk, then it's theft/fraud and the police are duty bound to take a report and investigate it. They have a bank account number to work with, so I assume they could start from there.

    Do you have any proof that you never received the item?

    Thought not, that's why the bank won't get involved.

    Even if you disbelieve the OP, why don't you wait for him to answer your question ?!

    Just out of interest, what form of proof would you be looking for in a situation like this?

    I don't disbelieve the OP at all in fact i do believe OP has been taken advantage of but I would say it's impossible to prove, its the OP's word against the seller's and as such the bank has no place to settle the dispute and side with either party. It is something that needs to be resolved between the parties and the bank cannot just withdraw the money from the recipents account - can you imagine the amount of fraud if all you had to do was claim you never received goods paid for?
  • you are right - I suppose I have no proof however the chap did put in writing that it had been sent registered post so there should be proof as I would have had to sign for it if it had arrived.

    Also, as per any online sales there is always a certain trust between the buyer and the seller that the goods are going to be supplied - this chap had good reviews from other buyers and I had no reason to doubt that this sale would be any different.
