Clamped and fined in private work carpark - reclaiming the fee?

It is almost a year since I was clamped and fined £100 removal in my work's carpark where I have parked for almost 6 years.

The system in place is that we have to display our parking permit to avoid a fine. Notices are in place to enforce this and as it is a car park on the outskirts of Leeds city centre, it is to deter the public from using it rather than paying for city centre parking.

On this particular day, I used my husband's car and forgot to move the permit into it and therefore got clamped. The fee to remove it was £100 cash and I didn't have that amount of money on me (neither did any work colleagues) and there were no ATMs nearby. To top things off, I was a few weeks away from giving birth so heavily pregnant.

When the guy came to remove the clamp, I explained my situation and he was very sympathetic and even called his boss to plead my case. My case being that I had absentmindedly forgotten to display a permit due to using my husband's car. The purpose of the permit system was not to try and make money from the workers who should be parking there but was to prevent those who didn't work in the building from parking there. Unfortunately, his boss was having none of it I had to get one of my colleagues to go and get me the cash and pay the fine so I could get my car back.

The guy told me I should appeal and gave me the details to do so and, the same day, I sent my letter of appeal. I then went on maternity leave and had my baby and never had a response to this letter of appeal (and was obviously busy with other things to follow it up!).

It was only when I saw Martin's email saying you can reclaim private parking fees that it reminded me of the situation and how annoying it was.

Does anyone think I have a case and should pursue it or has too much time passed and I should write it off? I have a copy of my original letter.

  • Right I'm not one of the experts but afaik a claim can be made up to 6years after so that should be alright
    Get copies of all the evidence--ticket, signs, release paperwork etc.
    If in a union use them as much as possible, maybe even get a copy of the terms with the clampers.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
