Car Accident

I am not sure if you can help me with my dilemma.

I had a car accident on the M25 on the 14.011.08 I was in the process of changing lanes when I was hit from behind. I made a note of the drives name, address and insurance details. I supplied him with my details. I then informed my insurance company. They referred me to the solicitor who was going to deal with my case.

The driver who hit me was driving a hire car at the time. He did not make me aware of this at the time of the accident. I received letters from the hire car company about damages to their car. I have sent all correspondents from them to my insurance company and solicitors.

A few months back I received a county court claim. I contact the hire car companies’ solicitors and advised them that their letter states that I hit their car from behind. I advised them that this was a mistake and it was the other way around. I was reassured that there seemed to be a mix-up and that they were going to issue a Notice of Discontinuance.

I have now received another letter from court advising me to pay them (Hire Car Company). If I do not pay them my goods may be removed, sold or other enforcement proceeding may be taken against me etc.

I called the Hire Car Company solicitor again to find out what was going on here as I was last advised that they were going to issue a notice of discontinuance. The lady who spoke to me was very abrupt and aggressive with me. She advised that the accident was my fault and that I was to blame for not providing them with my insurance details. I advised her that at the time of the accident I had provided their driver with my insurance details and my insurance company with the details he had provided.

My biggest fear is that this is court claim is going to tarnish my credit scoring. Over the years I have tried very hard to maintain a good credit score.

I would like to know if this county court claim is going to cause allot of damage to my credit score.

I would also like to know who is responsible for allowing this court claim to get this far. When I last spoke to my insurance company and solicitor they advised me that they have been in contact with the driver who hit me insurance company and solicitor. They have not had any contact with the hire car company or their solicitor.

If this claim had damaged my credit scoring who can I regress what has been done.

  • Do you have legal cover on your insurance policy?

    If so, forward all correspondence to them, and stop worrying about it.

    Unfortunately some legal cover is a complete waste of time for instance 'Albany Assistance' used by Admiral Group insurers. Thaman says he has already forwarded everything to his insurance company and solicitors. I guess being the usual c**p service, they have not dealt with it properly and as a result Thaman has ended up with a CCJ against him. Not sure how you get out of this hole. My advice, which is no good now, would have been to have dealt with as much of the paperwork yourself as possible rather than send it all off and assume it was being dealt with.

    Try contacting your insurers/solicitors to see what they say; if you are not satisfied, speak to Citizens's advice. You may have to issue your own County Court claim against your own insurers for full reimbursement. I hope you kept all the documents and sent off copies or at least kept copies?

    Sounds a bit strange, what is your insurer saying or doing? From what you say they know about this accident and should have been dealing with it on your behalf. That is why you pay them a premium. Get in touch with them and find out what is going on.

    It sounds like they have already got a judgement against you which is rather worrying.

    Who repaired your car (paid)?
