Reclaiming charges and writing off debt confusion

Hello all,

Just a bit confused about things.:confused:

I am currently on a DMP with Payplan and have been since 2007. I have paid off around 12k of my debt and still have about 14k to go.

I am aware than I can reclaim certain things ie charges and I have also heard that I can ask for agreements and if they can’t be supplied the debt can be written off.

Now what I’m unsure about is can I ask for agreements on credit cards and loans or is it just loans and does that still apply if the debts has been passed on.

For instance I had a Comet card and a House of Fraser card. Both are now with CL Finance. Is there any way of reducing these debts?

I also have a loan with Sainsburys Bank from 2006. This is now being collected by Bank of Scotland. Can I ask for my agreement and if so who would I write to? Sainsburys or Bank of Scotland?

    Have a read of http://www.legalbeagles.info/forums/showthread.php?t=13980 which should answer most of your questions and gives you all the letters you need.

    It applies to credit cards and loans taken pre April 2007. Write to CL finance and Bank of Scotland (ie the people who the debt is currently with), you should also ask CL Finance for a deed of assignment (explained in link) to ensure they are legally entitled to be collecting on that debt.
