Faulty engagement ring...need advice!

Hello! My fiance and I purchased an engagement ring from Kay Jewelers in December of 2008. A diamond fell out on Feb 14th of 2009. Valentines Day, obviously they were very busy. I was brushed off and offered two choices...repair it or replace it with same style. The associate wouldn't take the time to explain the quality of diamonds to me on the replacement, so I went with the repair to be safe. I was never offered a refund option. I got the ring back in 2 weeks. Then, had it inspected in June to protect my warranty, no problems reported. July 10th, two diamonds fell out again. Short story, they said it would be back in 4-6 weeks and that Kay Jewelers "doesn't consider diamonds falling out twice in six months to be excessive." Wow. Five weeks later, I called, now they are saying 3 months to repair it. They were informed I am getting married beginning of October when I originally dropped the ring off to be repaired and they promised to have it back in 4-6 weeks. They've offered me a "once in a lifetime exchange." When I asked what would happen if I choose to get another ring and then the diamonds on that ring continue to fall out, they basically said I would have to wait at least 3 months each time for the repair and they would never replace the ring again....even if they d/c they ring for a faulty design. They said they are "bending over backwards" for me....even though I've paid for a product I hardly have had. And, the price of gold has went up since we purchased our ring, and they are only offering to give us another ring for the same amount we purchased the original....so we are losing money. We want a refund and only a refund. They sold us bad jewelry and I could go on and on about how rude they've been...but I don't have enough time. What are my rights as a consumer considering my ring design is defective? We are planning to go to small claims.

  • To be honest, as a jeweller, I'd have thought the best thing you could do, would be to find a reputable jeweller, and have them repair your ring for you.

    Small claims court is naturally an option, but the cost of having the ring fixed by somebody reputable, would be roughly the same.

    Having a stone pop out, once, let alone twice in 6 months, is hugely excessive. Once in the lifetime of the ring is too often, unless you're talking about an 50 year antique.

    Sadly, if they're saying 3 months, it means they don't have good goldsmiths working for them, and are outsourcing the work to who knows where. Even if they do fix it, you'll never feel confident that it won't happen again.

    A reputable small jeweller, that is happy to do repairs, and comes recommended, will fix it properly, and you'll wear it care free for decades.

    Trying to fight the shop, is going to spoil your wedding, which is stressful enough!

    Seeing as nearly 10 months has passed since the OP posted, i daresay that theyve taken action or decided to let it go by now. In fact, they're probably married by now ;)
