legal advice credit agreement

hi to everyone.
i was hoping someone could shed some light with a situation im in. i lived in a flat owned by my boss and never recieved a gas bill. after a few years british gas came looking for payment and a bill came addressed to my boss's company (the flat was owned by the company) he obviously pointed them in my direction and they came after me.

to cut a long story short it wasnt paid and they have now put a dirty red DEFAULT on my credit history because apparently i have defaulted the 'credit agreement'.

heres my question,...... what credit agreement???
i have never seen, signed, or spoke about a credit agreement that i know of so how have a defaulted the terms of it?
can i get that removed off my credit file? surely i cant have a red mark on my credit file that says i didnt keep a credit agreement when there was no agreement in the first place?

any advice most welcome

    Welcome to the forum.

    Under the Gas and Electricity Acts of Parliament, as soon as you move into a property and use gas/electricity you have entered a legally binding deemed contract with the firm supplying that energy and are liable to pay for that energy.

    Without such a provision, the energy companies would have to disconnect the gas/electricty when the old occupants left, and not reconnect until the new occupants had signed a legally binding contract.

    With a credit meter,(i.e. not a pre-pay meter) you have broken the terms of that legally binding contract.

    Nobody ever signs a contract for their gas and electricity.

    How are gas and electricty companies supposed to know if a property is occupied or not unless the occupant tells them?

    The advice would be to pay what you owe the company.


    Do you feel you should not be liable to pay?

    If you could point at who was responsible for you bill, it would help your case, but you seem happy to have used the gas and to have sloping shoulders over who should pay. Presumably you said something to BG along the lines of "No idea, can't help you".
