Comet...Returning item

My mum and dad bought a tv bracket for their 42" plasma tv from Comet online and when it arrived it did not fit the TV despite being advertised as suitable for up to 46" t/v's.

So,they call Comet and they send a email with the return instructions as an attachment that has to be printed off and signed.

The item has to be returned to France, and the postage is coming to £25. My dad phoned copmet to enquire how he could be refunded for the postage but they said they do not refund postage.

Now this item was clearly advertised on their website as being ok for a 42" tv, therefopre it is unfit for purpose as it will not accept a 42" tv. Surely my dad is not responsible for postage?

I have told him to take it to the local store and get the refund sorted there, after all it is the same company and I don't see why my Dad should foot the bill for something that is their mistake. The bracket was £45, so after postage he'd only get £20 back.

Any advice.

Does it say on the delivery note anything about refunds? Sometimes they allow refunds to the store instead of postage.

Aside from that, they are not allowed to charge for return postage under the Distance Selling Regulations. I'm not too hot on that though, so I'll leave explaining them to the next poster

Yes they are allowed to charge for a return under the DSR's - but they must refund the full amount including the original P&P.

Don't know why it has to be returned to France, it's just what it says on the paperwork.

My Dad is going to phone again today and demand to be allowed to take it to a Comet store. Afterall, they made the mistake, if they want to send it to France they can, at their expense.

As I recall, Panasonics had a non standard fitting arrangement on the back of the screens

The Generic stands normally mention it fits most standard screens up to 46" or whatever.

Are you sure it won't fit ANY 42" screen, or just the model your dad has??

However Comet Online and Comet retail may be two seperate divisions of Kesa (Comets Owner) so they may and can refuse to return via the store network!

We don't have another 42" screen to test it on, but it won't fit the one my Dad has.
