Offer refund/partial? Or stand by listing.

OH placed an item on ebay. Stated in listing 'Looks in good condition and purchased as working from high street shop. Technically (and genuinely) untested for honesty!' at the top of the page very clearly
Now recieved this from buyer:
'Hi, Item received OK but I have to tell you that having put a new battery in it in accordance with booklet that it does not work. I saw that you had not tested this before sale but I am afraid that it does not turn on !!
Looking forward to hearing from you.'
Now its quite clear they are hoping for a refund or partial refund, and as it went for £14 plus p&p I can understand them being rather peeved to find it not working, but it was stated quite clearly it was untested. Should we just state this & risk a bit of trouble? Or no quibble offer them refund (leaving us out of pocket with a useless item). I think myself that a partial refund maybe as a good will gesture saying sorry but it was stated untested? Any thoughts please? First problem we've had besides the usual NPB.

If he puts a Paypal claim for INAD he will win (putting that its untested really means nothing). If it doesn't work and you haven't put so in the listing he will win. I don't do partial refunds I would ask him to return the item for a full refund. As the fact that its not working is not the buyers fault I would also refund the return postage.0
