Halifax PPI reply from C.E.O. Please advise.

Back in February 2009 I took voluntary redundancy, my PPI didn`t cover this and I got repaid my premiums.The mechanism I put in place to protect myself and family no longer exists and there is no chance of replacing it being unemployed. Since then I`ve tried to negotiate a repayment plan with the help of the local C.A.B.

The Halifax have used stalling and delaying tactics, failing to respond to my recorded delivery letters, plus letters and faxes from the C.A.B, until I asked my local MP to help. He wrote to the CEO of The Halifax on my behalf without response, he tried again and their reply was to impliment my repayment plan straight away and refunded interest and charges made to my account since May 2009. The reply also states, if my circumstances do not change then in 12 weeks time I will be isued with a default notice and my account transfered to The Halifax agents called Blair Oliver and Scott. The default notice will ask me for payment of the full outstanding amount however there is no need for me to respond. I will also continue to receive letters from Collections, however no action is required from myself as long as the arrangement is adhered to.

As much as I am gretaful, should I be entitled to more? The time I have expended on this subject, the recorded delivery letters I`ve sent, the constant telephone calls I received from First Assist back in May 2009, demanding letters from The Halifax without acknowledging my responses, aggressive letters from Albion Collections ( acting on The Halifax behalf ) asking for payment in full have all placed an un-necessary stress and worry to myself and family. Do I have a case for harassment?

I`ve already submitted a form to the FOS. Should I let them decide whether I`ve been unfairly treated?

  • Received a letter this morning from the CAB saying that my repayment plan of £10 per month would need reviewing and renewing in November. However, they also mention that should I elect to proceed with my complaint about The Halifax to The FOS then this would compromise the Bureau`s position and they wouldn`t be able to assist me in the future.

    I want to make The Halifax acountable for their actions and I feel the only way is via The FOS.

    Are there any other alternatives to the CAB who could help me complete a renewed repayment plan?

    I don't know of any other free companies out there other than the CAB. The FOS will give you lots of support in progressing your claim I'm sure so you could do it yourself.

    Just to bring this topic upto date, I contacted the FOS and have recieved a reply from them with their findings.

    Basically the FOS don`t think The Halifax have done too much wrong. Whilst they appreciate The Halifax could have handled things better and not been so long winded and obstructive, ultimately, the FOS are satisfied because the appropriate redress has since been repaid and as such I have been put back in a position as if my original offer of repayment dating back to May 2009 had been accepted.

    The FOS then goes on to say, whilst they appreciate the frustration caused by a bank using collection agencies to pursue the outstanding balance, this is normal banking practice. In these circumstances, they do not believe a bank attempting to collect money legitimately owed constitutes harassment.

    They also understand that I may have had to persist in attempting to arrange a suitable repayment plan both in using the services of the local CAB and my local MP. However, whilst this was unfortunate, the bank have apologised and in the FOS view the Halifax have offered suitable redress.

    I feel absolutely gutted and badly let down! I was hoping for more support from the FOS.

    Does anyone have any final thoughts on the subject as to whether I should appeal and on what grounds?

    Sorry to hear of this result.

    If you do not agree with the decision, you could of course let the FOS know, but wondering maybe a 2nd opinion on this within the FOS by another adjudicator.
    However, the snag would be the waiting again.

    Hopefully before you decide to do this someone on here may have some useful advice on where to take this one and will post up soon.

    The FOS is not there to give you support. It is to look at the fairness of the complaint.

    You are allowed to appeal to an adjudicator. However, based on your earlier posts, I dont know what you would be aiming to achieve from that.
