problems with selling a car privatly

Hi all
I recently sold a car through the local paper. It was advertised as the model etc, year, tax left and mot left. When the chap came to buy it, it was pointed out that it might not get him home...to which he repilied "don't worry, i am a member of the RAC"

I recieved today a letter from a solicitor saying that we had sold the car in "excellent condition". we are in breach of contract and the buyer needs to have his money back.

at no time was the car described at being in excellent condition

Any advice really grateful

    Contact citizens advice bureau, and hopefully you have kept a copy of the advert.

    Did you put 'sold as seen' on the receipt you gave the purchaser?
  • I would think that if you have put excellent condition in the advert or you said that to the person who bought the car, and its not excellent condition then they have some cause for complaint.

    If they however looked at the car and you were honest about any questions they asked then its their tough luck. You dont have to tell them anything, or disclose anything they dont ask when its a private sale, however I hope that most of us wouldnt try and pull the wool over someones eyes when it comes to large purchases like cars.

    Surely that doesnt matter if you put that or not it was a private sale.

    So what was wrong with the car in the end,presumably the letter told you this.

    Private sales are made on the basis of 'caveat emptor', so there's not much the buyer can do even if you HAD advertised it as being in excellent condition - they bought it 'as seen'.
