really needing advice re warranty - confused.

Hello - I bought a dishwasher (part of a kitchen) from B&Q in Dec 07. It was all delivered in June/July 08. None of it was fitted until Oct/Nov 08 cos we only moved in in December.
Dishwasher has stopped working. THey're trying to charge me for repair because they'll go by the delivery date for their 12 month warranty. I mentioned that i thought there was a european rule which gave me more warranty but the chap on the phone insisted that as we were in britain, we go by british laws.....
where do i stand? Please help, i'm keen to get it repaired asap and really can't afford a £100 repair right now.

    I think you're right about the European ruling. See http://www.guardian.co.uk/money/2009/may/23/tesco-consumer-guarantee for quite a funny story about a very angry man with a defective TV from Tesco, who made them give him a new one. LOL!

    You also have rights under the Sale of Goods Act. Goods have to be fit for purpose, and a dishwasher that stops working after a year or so of use is certainly not fit for purpose. See the Consumer Direct website for more info on exactly what you're entitled to under the Sale of Goods Act. (http://www.consumerdirect.gov.uk/after_you_buy/know-your-rights/electrical/) Don't try to argue with B&Q over the phone, send one of the template letters from the Consumer Direct website instead. If you mention BOTH the Sale of Goods Act AND the EU ruling in your letter, that ought to give B&Q something to think about.

    I'm really annoyed at B&Q anyway. Local branch has closed all its tills and put in those dratted self-service checkouts. Of course, every time anybody tries to buy anything that could be remotely considered dangerous (in my case, a filler knife, I kid you not), the self-service till stops and wails for an assistant to confirm that the would-be purchaser is not a ten-year-old delinquent. Imagine, how many products does B&Q sell which could be dangerous in the hands of a child? Took ages to get through.

    So please, do me a favour, go after them!!!

    Don't bother mentioning the EU Directive. Just rely on the good old SOGA...

    Good luck.. you will need it , as ( from my opwn experience) they will try and avoid as long as possible.

    Was item oputchased with credit ?... if so also involve the provider ( ie credit card, loan comapny)
