Redundancy Help

I am about to me made redundant due to company relocation but I have not receieved anything in writing from my employer, it has all been verbal.

I am wondering where I stand on receiving money in lieu of notice, am I entitled to this even though it was verbally agreed I would take redundancy about 6 weeks ago (I finish at the end of this month).

Any help would be most appreciated.

Thanks

You need to get the redundancy confirmed in writing. If you do not it may make it harder to get various benefits/insurances sorted out. It also leads to confusion (as you are finding)

You need to ask your employer to confirm:

    1) when your final date of employment is
    2) that your termination is due to redundancy
    3) What your notice period is and whether you are/have been working your notice up to this point
    4) if not, if this is being paid in leiu and when this will be paid to you
    5) what your redundancy payments are (if applicable) and when these are being paid
    6) what they will do as regards any accrued but untaken holiday (they should pay you this)

Make sure you do this before your work finishes and get their responses in writing.

Sounds like they didn't do much of a formal redundancy process either?

  • Thanks Pete, I will ask for all that to be confirmed.

With regard to the process, I was told we were moving, I was expected to go with them but it would be over 100 miles a day commute so I told them I wouldn't go and in effect they have made my job redundant as it no longer exists at the location where I am currently employed. I did say I was happy to stay until the move date which makes me think I am not entitled to payment in lieu of notice.

Ok - Sounds like you are happy to let any notice issue slide.

How long have you worked there?

  • Six years. I have now had a verbal offer of £900 over the statutory amount, better than nothing I suppose. There is no mention of redundancy in my contract. If I was legally entitled to the notice payment I would ask for it but there is also an issue of actually getting the money as the boss has a tendency to take any money we get in and I trust him as far as I could throw him!

Ok - let us know if they baulk at anything (ie holiday) and make sure you get everything in writing as before
