Claiming after using CCCS

Hi,
I have a couple of questions about claiming back bank charges. I was made redundant in January and have been out of work since and on Job Seekers Allowance. With my redundancy money I tried to continue with my debt repayments and also paid off some debt :-) but am since June have not been able to. I have contacted CCCS and my creditors to explain the situation and on CCCS advice am currently paying £1 a month to all my creditors.
However:
1: I have a claim in with HSBC that has been there a long time and is on hold. Can I still write to them and ask for my reclaim to be considered now that I am in hardship even though I am now only paying the £1 a month on my overdraft and personal loan?
2: One of the debts I paid off with my redundancy money was a overdraft with Smile and the account was shut down. Some time ago I did start the reclaim process with them also for charges on my OD, can I resurrect this one too due to hardship even though I am no longer a customer of theres?
3: I have an OD with Alliance and Leicester and have had some charges on that also, but never started the reclaim process. Due to the action with CCCS they have handed my debt to another company and when I go onto my web account I can not longer see any transactions. Can I start a reclaim with them now due and claim hardship?
In addition to these questions, I have the further problem that when I was made redundant, my work PC (as I didnt have one of my own) had my original letters to HSBC and Smile for the reclaim and I was not allowed access to retrieve them before I left. I do not have a copy of these now - so dont know the full amount I claimed for in each.
Can anyone help with any of these questions/problems?

Yes you can - they will probably use to refund to reduce the overdraft and loan.

You can - but Its doubtful you would get a refund under hardship as you no longer bank with them nd the charges would have been incurred outside of your period of hardship and probably not contributed to it. Still claim for after the test case tho.

- This request should include any Data held for more than 6 years as under the Data Protection Act there is no time limit for information requested.
- If you do not hold Data for a period longer than 6 years I also request confirmation of this in writing along with your methods used for disposal of such information to comply with the Data Protection Act stating the name and contact information of your registered Data Controller and Code Compliance Officer.

In your hardship letter explain that to them and ask if they could send a copy back to you (cheeky but worth a try) for your records. you dont NEED a figure to claim hardship - what you basically do is ask them to now consider your previous complaint nd explain your circumstances.
