    a flip of the coin could be that you had not taken care of your security details and allowing for the account to be compromised
  • i was in hospital for the last 3 and half years - longest iv been home is 3 months straight in one go during that time. i would not have imagined that she would do something like this...she is my mother . i left the infomation in my bedroom at my mums property and when i went to get it she told me shed put it all safe as i was moving out.
    i got my money paid into my dps account and thought my old account was not getting used.
    the bank told me that it was a overdraft as i did not even know what the debt was for.
    the letter for the sar request do i send it recorded delivery?

  • In all fairness, if they have put an overdraft on your account, without your permission, isn't that their problem? If you claimed ignorance of who had done it, then surely it reverts to them?

    The only problem may be who needs to 'prove' that it wasn't you.

    I am really not sure about how to tackle this situation but if they don't have it on record that you stated it was your mother (you may have been mistaken), then they may argue that it is up to you to report the fraud.

    It might also be worth posting this on the consumeractiongroup forum to see if they can provide a legal angle to add to this.
