Claiming back CC charges will in default??

Hi
I am on a DMP with CCCS,
one of my creditors Santander is killing me, every month they send out my statement and the charge me £12 for being over limit and £12 for not paying the min payment plus the £60 interest every month,
In the last year alone with CCCS paying £18.60 into it they have charged me about £900 in the last year, so im getting knowhere with them
the rest of my creditors have been great so far with freezing interest.
Quesitons:
1 - Can i claim back charges even though i am in default?
2 - how do i go about the process?
3 - what can i claim back? Interest + Charges or just charges?
4 - also as the charge is £12 * 2 will they deem that a small enough amount to charge?
Anyone had any dealings with this?

1 - Can i claim back charges even though i am in default? Oh yes

4 - also as the charge is £12 * 2 will they deem that a small enough amount to charge? Oh no no no!!!. Google OFT 842 and read point 1.14 of that report and you will see that it states that only a court can decide a fair charge

They won't unless they have closed your account, sent it to collections etc,etc,excellent, thanks

I too am in a similar position. With the CCCS, etc. I am currently going through Reclaiming Bank Charges under the hardship route and have been asked in a recent letter from NatWest to present myself at the local branch with the letter and some formal ID/proof of address?
They say this is to protect me against fraud? Is this normal as it seems such a strange request or there something afoot....
Any body had this situation?

I dont think they have sent it to collections,
Most of my creditors have not sent it to colelctions but have frozen interest as they can see it will take me much longer to pay it off.
But they must look at it and say the more they charge me the more money they make..
ill try sending a letter asking if they can freeze interest and see what they say, failing that, ill just send a letter once a month.

Be careful of the line '...we'll stop the interest...'; ask for confirmation in writing as I had the NatWest pull the rug out when said this and didn't do it.
