Hi can someone give this letter the once over to see if it's okay. Thanks to all who have helped me so far:T

I purchased the above policy from you in 15/11/2004 but now believe that I was mis-sold this policy for the following reason:
This is due to the fact that I was not given the correct information when the policy was sold to me, as
    * your salesperson had marked the box on the form to request the policy.
    * your salesperson stated that it was compulsory with the credit.
    * the salesperson certainly did not explain that this policy was optional.
    * your salesperson did not give me full information on what the policy would and would not cover.
    * your salesperson did not enquire whether I had alternative cover, which I believe I had.
Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.
I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.
    Yours faithfully

    Thanks again, :rotfl:Gil

Thanks Marshalka, I will just post the letter alone. Cheers:T
  • Can anyone explain this paragraph to me? It was in the letter that came with my SAR info from Direct Line:

"I regret to advise that we do not provide copies of underwriting, loan assessing reports. We use a computer assissted system to aid in decision making. All decisions are conducted in a fair and precise manner. We are unable to supply the logic of the decision making as this constitutes a trade secret. I would draw your attention to Section 8 paragraph 5 of the Data Protection Act.

I also applied for the loan over the phone but they have failed to provide any info on the conversation. Do you think that it is that they may not have this info as the loan was taken out in Feb 2004? Anyone...
  • :confused:Sorry for this again, but who should I send my first letter to, RBS who have recieved the money for the SAR or Direct Line who have sent my details?

    Hi Gil

I am not too sure on this, but if your concerned about this, in case they are not providing you with everything as requested, you could contact the Information Commissioners Office (ICO), explain the above to them and see what they think on this, here:
    https://www.ico.gov.uk/Global/contact_us.aspx
I think it would be better to ring rather than email them though, as it may be a while otherwise before they respond.;)

It would be whoever actually sold you the PPI. If it was sold to you by Direct Line over the phone then it is them and if it were RBS its them.;)

    Hi Gil

    You mean the reclaim letter?
You send to the ones who arranged and sold you this product.;)

  • :TThanks for the help di3004, just phoned them and it basically means they can't give details of the way they decide whether or not to give you the loan, nothing more than that. They also told me to send Direct Line another letter asking for transcripts of the telephone application made with them. Think I read somewhere that I give them another 7 days to provide this info.
Also found the address for Direct Line & The Royal Bank Of Scotland are the same. RBS & Direct Line have both sent me letters regarding my SAR for Direct Line, both from Lombard House, 339 Southbury Road, Enfield,EN1 1TWY. Thanks to All who helped with these issues.:T:T:T
