tescos faulty laptop? full refund?

my husband purchased me a pink medion laptop from tesco's, christmas 2007, the laptop delveloped a major fault roughly 14 months after purchase, one night using laptop horrible smell came from under keyboard like tcp, and then it would not charge. we contacted tesco who did give us a 50% refund, only 50% as they said general wear and tear etc, personally i was not happy with this,but dh said it was better than nothing. but now hearing about the new eu rule that goods should be guaranteed for 2 years. do you think i would have a good case at getting the other 50% back? considering it cost £450.00 and only lasted a short while, they never even asked for the laptop back for possible repair etc.

any advice appreciated.

    No, you don't really have any case to get the other 50%.

    Tesco have fulfilled their obligations by giving you a partial refund, taking into account that you have had 14 months usage out of it. Techincally this implies the expected life of the laptop to be 28 months, but you may not be able to get any more out of Tesco.

    OP, you have accepted their offer of 50% refund.

    You maybe could've refused their offer, but once accepted... thats it.
  • Just to point out in addition, EU law does not state that it has a 2 year guarantee. Besides, the Sale Of Goods Act has the same provisions for up to six years in England and Wales.

    Like KeithP said, you've accepted the partial refund so further action would most likely fail. However, after the first six months, the burden of proof of inherently faulty goods lies with the consumer. Since it is now nearly 24 months down the line, and I doubt you still have the laptop, this is going to be nearly impossible to prove.
    Any advice or opinion is only informal advice to the best of my knowledge. Just covering my back, yadda yadda.
