I received a call today from a Case Handler who is dealing with my hardship case. Regrettably I missed the call, so they are calling me back tomorrow. Fingers crossed we will get a result, however, I am realistically prepared that we could come out of this will nothing. We have already clocked up £300 in charges in the last 2 weeks.....
Will keep you posted!

Keep us posted and make sure anything they say they will agree to is put in writing first so you can make a decision.I received a call today from a Case Handler who is dealing with my hardship case. Just a quick update!
My case has now been assigned to a handler and we went through the income & expenditure forms on Friday. From our discussions, we identified that the point that instigated our financial challenges was back in March 06. I am presuming that under financial hardship, the bank are only obliged (if they see fit) to refund charges during the period of financial hardship and not before. If this is the case, then I know that any refunds will be a whole lot lower than the £6k that I originally claimed for! However, in my mind, anything is better than nothing.
The case handler is now looking at our accounts and will come back to me within 14 days, but he suspects that it will be quicker. Fingers crossed that we get something back just now, as this continual financial battle is so exhausting.
Good luck to everyone who is hoping for a refund...0 -
By accepting any offer , you will not forego the remainder of the claim. Any balance will be refunded after the outcome of the OFT test case.If this is the case, then I know that any refunds will be a whole lot lower than the £6k that I originally claimed for! Got a handler three hours after video went live. "Will be sorted in five days." Wasn't. I called; they called back: they're waiting for their report to be 'actioned'.
They phoned back on Friday - I "will receive the offer on Friday or Monday". Didn't. But they DID say this: "because your account had your ex-wife's name on it, we have to give half the refund to her." I pointed out that [if they check my plethora of complaints they'll see] not only did we divorce seven years ago, but we both wrote to and phoned Clydesdale, asking them to remove her name. They kept saying they couldn't and would have to set up a new account, with no overdraft facilities... yadda yadda.
He says he will hunt down the relevant complaints.
I have written to a number of MPs and MSPs, and have set up a meeting next week to try to raise awareness of an aspect of the issue that is glossed over in news reports.
If I may: a lot of the tone of news reports is 'people in debt' 'overspending' etc. Giving some [self-] righteous folk (I have come across) the idea of saying: "if you didn't spend what you don't have you wouldn't get charged" - what I'm trying to draw attention to is the following: one - so what if you ARE in debt? It's meant to cover costs, NOT be punishment. two - take this scenario: Not in debt; not overspending. Wages every month of £1000. 6 DDs of £800 and you get by on the £200 left over. One month wages are late. 6 bounces at £35, and an 'overdrawn' charge of £25. When the wages come in, you are down by £235. You now have £765, so some DDs are paid, one bounces. Next month you have £1000, but minus the last set of charges and now you have to pay two months' worth on the DD that was bounced a second time. An almost exponential downwards spiral, which (in my opinion) is tantamount to constructive bankruptcy. I intend to make as much noise as possible with this.
I shall post info on the offer when/if it comes.

Having been told a letter was on its way, then having heard nothing, I called Clydesdale on Tuesday: they said they would check it and get back to me that day. I called again on Thursday to remind them. They said they would get back to me that day.
They did! They left a message saying a letter had been sent that day and I should get it today or tomorrow.
So when they said they had sent a letter: were they mistaken or lying?
: )
