oh dear this is getting heavy lol..ok just a couple of questions please....
where is says:
Please treat this letter as my request made under CPR 31.14 for the disclosure and the production of a verified and legible copy of [each of the following / the] document(s) mentioned in your Particulars of Claim: what goes in the brackets? also
The assignment*
3 The default notice*
4 The termination notice*
5 [any other documents mentioned in the Particulars of Claim]*
* delete if not mentioned in the Particulars of claim.
Do I have to delete any of these…?
what do I do when I get a reply? do I hold on to my N9B for now, until I get an answer,(when/do I send it off) just worried you guys might not be about when I get a reply and I won't have a clue what to do....what exactly am I asking the Solictor for, is it proof of what I own...really sorry, asking all these question, but law isn't my thing;)...Lilly0 -
Try this:Please treat this letter as my request made under CPR 31.14 for the disclosure and the production of a verified and legible copy of each of the following documents to enable me to file a full response to your claim.
1 The Original Littlewoods Agreement
2 The assignment between the Original Creditor and Phoenix Recoveries
3 The default notice
4 The termination notice
To be perfectly honest with you, you are wasting your time filing a counterclaim on this one.
As already commented on, Mr C has given you more than enough ammo to bury himself

Thanks CurlyBen, but can I just ignore the counterclaim, haven't the court got to been notified, and expect a reponse from me....If mr C drops the charge as such...won't I have to notified the court? sorry to appear so uneducated, but as far as the law goes I am...maybe I should stop jumping the gun and await Mr C reponses ah!...;)Lilly0

TBH Mr C has a tendency of dropping claims BEFORE they even get to court.
Most of his actions are simply threats.
No matter, if he ignores your request we'll hit em anyway.
I forgot to ask did this claim come from Northampton bulk Centre ??Signature Space for Rent

Yes it came from The Northampton (CCBC) I ask at my local Court (WoolWich London) last week a couple of questions about sending of my acknowledgment service form back saying I was defending the case....the guy at the court checked his comp, and said oh, its not been sent down here yet, thought it would have been! anyway best get that letter done and recorded tomorrow...I will of course update you , thank you so much, I wouldn't have know how to have done this. I would have ended up going to court completely unarmed........lol...Lilly0

Northampton dont tend to pass cases to local courts till after defence's are in.
You're in good hands with Curly
