Nationwide have sold my overdraft to a debt collection agency because I moved house

    Nope, I ve had one of these letters and it states

    Dear Mr/Mrs X

    Thank you for changing your address with us. Doesn't confirm any addresses
    Should you need to contact us, blah blah blah.

    That's it, no account numbers

    If someone has already managed to change your address without your knowledge then I would imagine they have all the information they need. ;)
    Anything I post is my opinion, so from time to time I may be wrong. I try to provide answers based in fact, however I don't know everything, so (like all posters on MSE), take what I say with a pinch of salt.

    Have you formally written a letter of complaint outlining the facts of the fraudulent use of your card?
    If so what is there reply?

    Nationwide don't make life easy, do they? They will not accept change of address by telephone or even in a letter. You have to go to a branch, when they told me I would have to come back as they did not have the correct form available. Proud to be different - yeah right.

    I've just had a quick look at the back of my statement and it says you can change your address by completeing the online bank form, the OP says they do have online banking. Also you can let them know in writing at a branch or by posting a letter to Swindon. So they do accept a change of address by letter. I think they do this so they can check the signature.

    It would appear NW gave me incorrect information or perhaps changed their system since I asked them?

    When I phoned to ask, I was told I must request a change of address in person at the branch. Hard to do when I was in spain :rolleyes:

    FYI, item6 on reverse of my ISA statement is different to item 2 on my Flex & Regular Savings statements.:confused:

    Nationwide have changed the information on their statements. In November 07 when you moved statements had a change of address section on them, you just had to complete that and post it to Nationwide. Have you not been back from Spain in the last 2 years?

    Suggested action to take re Debt collectors - Lots of solicitors offer a free 30 minute appointment, you could find one of those local to you and make an appointment to see them, they should be able to help. It might be easier than the CAB as well as you have to queue at the CAB (I think).

    It seems the NW assistant gave me duff information. Can you explain why note 6 on ISA statement has not been updated to reflect the change?

    I can't see the argument you have with the bank.

    Whatever has happened is 100% your fault for not looking after your financial affairs.
    If someone has used your account, it is because the card arrived at the incorrect address because you didn't inform your bank.

    The £170 charges + £60 taken will just serve as a monetary lesson to you to be more careful.

    It is your debt though.
    Therefore i seriously doubt you will not have to pay it.
    It will already be on your Credit Reference file by now anyway.
    The debt is not your, it is a fraud so doubt court would rule against you
    The court would only accept mitigating circumstances of fraud if the OP took REASONABLE CARE to avoid the fraud in the first place.
    She clearly didn't so will be found liable (and probable court costs aswell).
    I don't know if other banks accept change of address on the phone or not.

    Halifax
    Lloyds
    Barclays only accept written confirmation with a signature or a personal visit to their bank

    I don't work for Nationwide but I do have accounts with them, the information I've provided is from statements that I have (I keep them for a few years before shredding them). I've also moved house and when I did I sent change of address notifications immediately I also arranged for my mail to be redirected in the short term to make sure no one got my information.
    I've not got an ISA account so I can't look at an ISA statement, I also don't know why you were told you had to go to the branch. That said, you knew your address hadn't been changed.

    I'm surprised the frauster only took the account £60 overdrawn you hear of some dreadful stories in the press.

    I still suggest getting legal advice you can then contact the debt collectors quoting the legal advice you've been given if it's in your favour.
