Car Failed MOT

Options
I may on the wrong thread, apologies if I am.

I took my car for a service and MOT today. Unfortunately it failed its MOT due to a shredded handbrake cable (fair enough) paid to get it fixed and got it re-tested. What Im miffed about is 2 weeks ago I took my car along to Vauxhall (where the car is originally from) and told them that the hand brake wasn't right and hadn't been since I'd had the car (been in at least 4 times in regards to this) They told me that they would take the drums off and inspect the hand brake.

When i went back they said that all that was wrong with the handbrake was that the drums needed cleaned up and that theyd done this. Handbrake appeared ok but now 2 weeks later its apparently shredded to pieces. The car has hardly been driven in the last 3 months either.

When I contacted them today about it there answer was "meh it happens"

Am I entitled to ask for my money back as they should have spotted this? Or is it "just one of those things" lol.

If you took the car in before the MOT and pointed out that there was a problem with the handbrake then they clearly haven't done the job you asked them to do and had they done so, the car would have passed the MOT. I would ring them again but insist on speaking to the manager or whoever is in charge of repairs and servicing and tell them that they haven't carried the work out to a satisfactory standard as they returned a car to you that wasn't roadworthy. The answer "it happens" really isn't good enough.

It might be worth speaking to consumer direct too just to see where you stand.

    Good luck!

Especially since you didnt give them a chance to fix it.

Huh? The handbrake has been to Vauxhall numerous times to be fixed. Most recently 2 weeks ago. They apparently fixed it. I then took it for an MOT today which it then failed. Dont quite understand how I didn't give them a chance to fix it?

I really think you should have read my OP more carefully. I have stated in it that I did phone them. They have taken money for a job which they have not done and another garage has then failed the cars MOT for the handbrake. Again please explain how I did not allow them to fix it?

Or maybe the handbrake was already weak and having a dealer !!!! about trying to fix it with the difference after meant it did fail.

Also worth saying that making it better doesnt necessary mean it must pass the MOT

you can obviously complain but dont see were your going. Especially since you didnt give them a chance to fix it.

The OP expressly asked that the handbrake be fixed. The garage couldn't have fixed it properly if it was so bad that it failed the MOT. I would expect that if I asked for a handbrake to be fixed, that it was fixed to the minimum required to pass the MOT

It might also help if you can get the garage who did the MOT to give you their opinion as to whether it had been broken for some time, preferably in writing.

After you had paid to get it fixed so your tough out of luck. You cant just get it fixed then call them and expect it to be paid for.

Excuse me?? I am completely lost to what your getting at here. Are you trying to insinuate that I'm trying to get my MOT for nothing or something? I am more than happy to pay for the MOT and for that particular garage to sort the problem. I am not happy that I have had to pay Vauxhall Evans Hallshaw money for a job that hasn't been done to a bare minimum standard to pass an MOT.

Ivory Tinkler & Peachyprice: Thanks for your input on this matter. I will contact them in the morning and see if theyll give me the details in writing. Then I'll look into reporting them to Consumer Direct. Its not the first time they've !!!!ed up on my car.

No I am saying legally you are expected to give Evans Halshaw opportunity to put the problem right. You cannot just ignore to tell them then expect them to reimburse you for the repair cost.

You havent said were the MOT was done. Could you confirm this please?

Well in order for the car to be safe and pass its MOT the handbrake cable had to be fixed. I was not driving the car with my 10 week old baby in it if the car was unsafe. And if i did drive the car off the forecourt then i would have had to pay for my retest. Also AS PREVIOUSLY STATED I phoned Evans Hallshaw and told them this after the garage called me and the answer was "meh it happens" they were not going to even attempt to fix it. You would have known this if you had taken to extra 30 seconds to read my OP correctly!

The garage is a local one who i've always taken my cars too. Don't see why this has any impact on the issue.

    Anyway wheres the ignore button?
