I have just been on my online banking and I have just been charged £105. This is due to apparent direct debits which I didnt have the money to pay, I was a day late.
This apparently happened at the beginning of the month, and they have just taken it out today. They haven't emailed, sent a letter or anything. I have been on the phone to the manager who says theres nothing they can do; they are well within their rights to take the money out without notice.
I cannot pay my bills now, so what can I do? I feel sick at the thought of having to tell my landlord I cannot afford to pay the rent.
I cannot believe they have just taken this money out, it really is alot of money to me and my partner and the manager wasnt sympathetic at all.
Any help would be greatly appreciated.

If you are already in arrears then you may be able to claim under financial hardship0 -
Hi, thank you for answering.
Turns out that we did have enough money to cover the d/d's on the day they came out, but in the terms and conditions it states you have to have enough money 48 hours before a d/d comes out.
I have tried to claim the money back, the manager said she cannot do anything where we have had one charge refunded on this account before. Can they really just take money out without any notice?
How do I go about taking this further then? Apparently halifax have sent it on to the complaints department but she said ' they will probably only say the same thing as me'.
I just desperately need this money back, but its seems I am at a dead end?

They can take it out without notification and you need to start the process of reclaiming.0 -

Have printed a letter which I will send today. Do I just have to hang on until next January then?

Pure speculation but interesting to know. Is this not widely known then about January 2010 being when the decision is made? If not, how long are people expecting to wait for their claims to be handled either way?

Part 1 is whether the OFT can assess terms for fairness which we are awaiting the decision on, the second part is which terms are unfair as well as how far back claims can go back.
