Unemployment Benefit

I am looking for advice, my husband has just started a new job where he is working for 21 days and off for 21 days he gets paid a day rate for the days he works but then has no pay for the other 21 days I would like to know if he could claim unemployment benefit has during this time he is not working and is receiving no pay? I have phoned jobcentre but they are not sure and my husband needs to have a telephone interview. Any advice would be welcome as we do have a family and will be financially struggling.

    They may decide that there is a recognicable cycle of work i.e 21 days on and 21 days off - they will divide the whole period by the amount of work he does in the 21 days work and if the weekly hours works out at 16 hours per week or more he will be treated as in remunerative work and cannot claim JSA.

    Then the answer (With regards to JSA/IS) is no he cannot claim. He is working more than 16 hours a week on average and his income is also probably way too high.

    EDIT: I shouldnt say he cannot claim, as anyone is allowed to put in a claim, it is my opinion based on the guidance available that he will not be entitled though.

    he will be working 84 hours a week for 3 weeks then nothing for 3 weeks so this will average out at 42 hours per week, seems similar to how oil rig workers work and they cannot claim unemployed in their off weeks.

    I would also guess that his annual salary is going to be substantial if he is working 21 days on/21 days off. So he will be expected to budget his wages so that it lasts the period when he is not working. It is going to take some careful budgeting, so I would suggest the OP gets over the OS board.
