Bought item 6 weeks ago, still with tags and receipt

Hi all,

I bought a suit from Next six weeks ago, and never took the tags off. I still have the receipt. The other day I was about to put the suit on for the first time but noticed a small hole in the trouser legs which I obviously didn't notice when I bought the suit.

It was bought in the sale, but as it was technically 'faulty' when I bought it, without me knowing, should they give me a refund or at least credit note?

Any help would be greatly appreciated, many thanks in advance.

    Have you taken the tags off or are they still on it ? If the tags are still on you probably have a better chance as they will see that you haven't damaged the suit while wearing it.

    I don't know for sure but if I was in your situation , I would expect the store to refund me UNLESS the fault was identified at the point of sale (even if it was just labelled as 'seconds' or substandard'. I would expect sale items to be undamaged unless a fault was drawn to my attention before purchase.

    Your rights are not affected by an item being purchased in a sale. So I would say that you have a good chance of getting a refund as you clearly have not worn the suit and it is faulty and has been since before you bought it.

    Will they though! I have heard of many women who wear something once (with the tags still in but tucked away) only to take it back the next day!! (And I am NOT saying this is the case here in anyway).
  • 'Not fit for purpose' so, yes, they should take it back. I think your greatest dificulty might be convincing them that the damage happened prior to purchase, though, rather than after you bought it - so if it looks like a manufacturing fault (ie the hole is where a seam hasn't been stitched properly, or the material has the equivalent of a dropped stitch) then your case will be stronger - they might just argue that the damage has occured while it's been in your possession if it's something like a 'catch'. I'd go for just taking it back, explaining why you're returning it and pleasantly, but confidently anticipate the refund. There's a chance they won't even mention/see the time lapse; if they do, at that point you will need to explain why there's been a delay, and why that doesn't make any difference to the bottom line which is that there's a manufacturing fault and the suit isn't fit for the purpose that you bought it for.

  • Before you start worrying, just go into Next, explain the situation and see what their response is. They may well sort it for you without question - problem solved!

    the hole might even have been caused by the security tag.
  • I'd take it back :cool:

    They might offer you a refund card at first but stick out for the cash or maybe but it towards a new suit, next have a range of £90 suits

    If the hole is on or around the seam its most definitley from the security tag as pre-sale everything is de-tagged with hand tags as opposed to the more smooth till tag units

    I have to say that NEXT are usually pretty reasonable regarding returns in my experience anyway. I've taken stuff back way after the timescale stated and never had a problem.
