Taking Insurers on-conflicting ideas...

ok - the story so far....
Stonebridge refuse to pay out on late fathers accidental death policy, as say coroner report saying natural causes out trumps ambulance report stating that they had to remove blockage from his throat before they could tube him (basically,he choked,then collapsed, and died when he arrived at the hospital)
I apealed, on the grounds that we know (and have provided witnesses!!) that he was in the kitchen - and got told no.
Went to ombudsman - who agree with the insurers - have my final answer from them too
so, next stop is a solicitor - its not even about the money - obviously the £25k would be useful, but its more that they are insistant on telling us that it wasnt an accident - and it certainally wasnt planned!!!
SO - long story short - has anyone ever set a solicitor on an insurance company and what happens??? I need some moral support for this !!!

Are you sure they are telling you it wasn't an accident?
Might they be saying that it would usually be a survivable incident? but natural causes caused him not to recover.
Just a thought. Obviously you have the full details so have more info than me but I'm jsut wondering whether the interpretation is not as inteded.
In my view once the ombudsman has said no you have to accept it.0 -

Going to be very tricky arguing against a coroner's verdict though. Think long and hard about going down this route trudij.0

You can go to court after the FOS. However, the FOS is slightly more consumer biased than a court would be. A court would just look at law. The FOS look at that as well but do include fairness in their decisions.
I would think in this case the Coroner does trump all others.
Accidental death plans are a waste of money. Indeed, that is why so many are given away free. Very few deaths get classed as accidental.I am an Independent Financial Adviser (IFA).
