Can sellers add this disclaimer to their listings?

I've being doing lots of searching on eBay this week (want a new winter wardrobe without the cost!) and have seen this so many times.

I ask mainly because I lost out due to 'lost post' a few months ago - I just refunded the buyer and decided to send Recorded Delivery from then on. Can sellers be forced to refund if post goes missing?

As a buyer, I'd be really annoyed if I wasn't refunded and didn't receive my item. I'd definitely leave negative feedback - is this just a risk these sellers are willing to take?

  • They can put it in but it means nowt.

    If it doesn't arrive you claim, they pay out and then claim off RM.

    They can state what they want, spit their dummies out and stamp their feet but that's how it is.

    Just ignore it if you claim through paypal for non receipt theu will just refund you.

    As said previously as long as you pay by paypal you have insurance there.

    And you should be sending via recoreded /special delivery if items are of value - so doubly insured

    The insurance on Recorded delivery is the same as standard postage with proof of posting £39. Items over £39 best to send special delivery

    Thanks very much for all your replies. I was pretty sure the disclaimer meant nothing, but I wonder what the sellers are thinking will happen if something they sell does get lost? That their buyer will just back away meekly, thanking them for their troubles? Strange world some people live in!
  • That would put me off buying from a seller, as it suggests something about their attitude toward their trading and buyers.

    As previously said PayPal would refund you and the seller should claim off the Royal Mail. They should get proof of posting to get the £39 coverage - if they can't be bothered and something goes missing then that's their loss (literally).
