Ebayer buyer has stolen £675 help!

My husband sold a krugerrand on Ebay for £675 a couple of months ago. The buyer paid via Paypal, the coin was posted Special Delivery with insurance and was signed for the other end. The buyer left positive feedback, my husband withdrew the funds from his Paypal account.

A few weeks later Paypal informed my husband that the buyer's credit card company had issued a chargeback for £675 and no reason was given for this. Paypal say this is because it was instigated by the buyer's credit card company rather than themselves, and they can't release any details of the buyer's credit card company or account details. They have stated that this could take up to 75 days to resolve, but will not provide any status updates, although they have demanded all pertinent evidence of the transaction and proof of posting and delivery, which has been provided. Paypal has said that my husband will be crosscharged any handling and processing fees charged by the credit card company in investigating this issue. The buyer has not responded to any emails sent. Paypal asked my husband to restore his account to credit which he refused to do. Paypal then transferred the amount, without any authorisation, from his registered credit card to his Paypal account (but did so using Euros converted to Sterling using the prevailing exchange rate, which means that the sum transferred is greater than the original sum).

This complaint has been logged with Ebay who in turn have done nothing and certainly have not banned the Ebay member in question. Where do we stand in all this and what are our rights? We thought Ebay and Paypal are duty bound to protect the seller as well as the buyer. It looks as if not only have we had a valuable coin stolen but will have to pay over £675 to 'make ammends'. Any advice will be gratefully received thank you!

  • Thanks good idea! I've now posted on the Ebay Forum and have got quite a few replies. I would still be interested to hear of anyone else's experiences here or any other advice to follow.

    As Paypal took the money off your credit card could you not get your CC to do a charge back?

  • I think now my husband intends to call his credit card company and ask if it's possible to do a charge back. Trouble is the teeny tiny small print of Paypal may well say they are entitled to do this!

    email your local Trading Standards, and copy the BBC "Watchdog" programme - PayPal; get so much bad publicity taking cash (unauthorised) from people's cards that it's INEVITABLE they will do a big splash on Paypal.
    Aren't PayPal now owned by eBay?
    Because the money involved is connected with a USA company and traversing Federal borders, I'd copy the Securities Exchange Commission too, and the FBI for good measure.
    Just kick up all the dust you can, DAILY, and show them you're not going to take their criminality lying down.
    Build a diary of their ineptitude and reckless disregard for your complaints.

    Honestly, this forum is bad enough when people keep saying "contact trading standards" for every small minor problem imaginable. But suggesting she contacts the FBI?!?! :rolleyes:
