Reclaim PCN: Scotland

I have read several posts here where the poster has advised on how to have unfair PCNs dropped. I would like to know if it is possible to retrospectivly claim back if I pay a PCN that is later proven to be unfair?

I recieved 2 identical PCN within the space of 1 month, both of which I believe to be unfair and that I am 99% positive that I will win my appeal when I reach the SPAS (Scottish Parking Appeals Service).

The 1st I have appealed to the council, they have rejected and provided me with the option to Appeal to SPAS.

The 2nd I missed my original appeal date and was served with the notice to owner, I appealed to the NTO as per the instructions. However now the council are claiming that they did not receive my 2nd appeal at all and are now threatening me with the Sheriff Officer. (I did not send registered post, I know now that I should :o )

If I pay the 2nd one now to avoid dealings with the Sheriff Officer. Can I later claim back If my first appeal to SPAS is succesfully and thus proves that the second PCN was unfair?

Latest reply from Council:
Further to your recent email and after careful consideration of the facts I must uphold the decision, in that you are out of time for your Appeal. You claim that you have submitted a letter but have not yet provided any evidence to support this.

Therefore the Charge Certificate stands and I would ask you to forward full payment within 14 days to avoid the matter being forwarded to the Sheriff Officer for collection.
