Notice To Owner - No Ticket

Hello,

I have received a NTO today, dated 27/08/09 for an alleged offence on 22/07/09 from Enfield Council. (£100 Fine)

I was parked in a loading bay outside a furniture shop, collecting a table.

Basically I came out of the shop with the table, saw the "enforcement officer" standing in front of my car, told him that I was going, slung the table in the car and drove off. There was no ticket issued/attached to the vehicle.

The NTO contains my tax disc details but the photo does not show a ticket (obviously) and the NTO states the address as "London Road" only. (It does not state what number the car was parked outside an I am sure there are other bays on this road with different restrictions)

Any thoughts?

    Straightforward appeal on the basis 'no PCN served' and ask for the CEO's notes.

    Remember they could have got your tax disc details from DVLA by the time they send an NtO. They may claim the CEO took them and hence did serve a PCN as there was plenty of time. Don't mention it yet.

    Also mention that you were loading at that time and that you did see/speak to the CEO.

    See how they respond.

    I thought that tickets could be deemed as served now though, even if they were not attached to the vehicle?

    Was this a Regulation 10 NTO/PCN ? The loading exemption should cover it unless the signage disallows loading.

    You said you received an NtO.

    If a PCN is not served on the vehicle or handed to the driver then they must issue a postal PCN -- Reg 10 as Cris mentioned. It serves as an NtO but is not titled such.

    Confirm what you have actually received.

    No, I never received a PCN either on the vehicle or in the post, just the NTO.
