Broken Vespa

Hello, I bought a Vespa from a trader last Saturday,I paid cash. It was not taxed, so I got it home and got the tax on Monday.
When I took it out, I found it was losing power and would cut out.
I called the place I got it from, and they explained what may be wrong, and bring it in as soon as I can ( which is tomorrow,Saturday) and they will have a look. I have since decided that I dont want it fixed, as I am not happy about it not working in the first place.And am also worried about it breaking again.
Am I within my right to ask for a refund?
PS: Gutted, cos I wanted to go to the IOW scooter rally for BH weekend..:mad:

In what way? Its not a fault i caused, it went fine on the flat, but wouldnt get up a slope..0
