Barclays - Reserve Usage Fee

I've been reading a lot of the information on the topics and in the forums, but I haven't seen the Reserve Usage Fee come up or be mentioned. Is this 'fee' covered by the data protection act letter and is it a valid 'fee' to reclaim?

Basically, I was at the limit of my overdraft. Then, Barclays put in an account fee of £7 which put me over my overdaft by £4, so they subsequently added on a £22 charge for using the RUF. I'm sure this has happened before. The problem lies in the definitions, as far as I can see. In the letter it's refered to as a fee, while on the statement it's refered to as a charge.

    RUF's are reclaimabl;e albeit they are outside the FSA Waiver yet inside the OFT test case since it has never been challenged in the courts.
    I would advise you to get barclays to remove the Reserve from your account.

  • Thanks, that clears up one part. Is it covered in the DPA letter though? It doesn't seem like an unauthorised overdraft from they way the RUF is worded, more like a hefty fine for using an unasked for service.

    You cannot unask for something. For example, I cannot unask you a question cos how would you know I asked the question?
    DPA= Data Protection Act.....it is not about a specific charge but about data.
