it's all going wrong

Hi all,

I am moving in a fortnight-LA has checked all the refs etc and I'm good to go.

No, I'm not excited. There is something about sitting here executing all these plans and suddenly it all jumps off the screen/notepad and is something real and I'm just not ready for the leap.

I feel like diving under the duvet and sobbing like a baby. My chest feels tight with all the stress.

I have 2 new things to worry about. My catalogue of worries is getting beyond what anyone could consider reasonable.

worry no.1- it seems my claim for LHA won't be considered whilst I am still a homeowner.

worry no.2- It will take ages after I go BR for NR to repossess the house because they will go after ex and see whether he can pay up first.

worry no.3- I can't take anymore time off work to move, how the hell am I going to do it on my own? Moving costs money- the BR charge is going to clean me out. I can't earn the money quick enough to get out of this mess.

worry no.4- I am seemingly going to have to tell exhb of my plans earlier than I planned because I think it's time to tell NR I wan't to surrender the property- I see that as the only way of moving the repo at any speed.

I feel like the past two weeks have all been for nothing. I have planned and planned and despite myself have even looked forward to a brighter future. I can't take anymore stress. I'm alone at home and I just want to get in the car and keep driving.

I know there is no magic wand to fix all this. I just thought it would make me feel better getting it out in the open......wrong again.

If I list my rent on SOA the OR will assume I can't cover living costsl, let alone any surplus for creditors.

That's another thing that's worrying me.

Don't worry if your income doesn't cover your living costs - this should be temporary until you can start claiming housing benefit. My outgoings were more than my income on my SOA and it wasn't a problem.

As for the rest - one step at a time. It will soon be over and you are taking positive action. BR is a rollercoaster of emotions and that is just what you are going through now. It does get better - we've all been through the same thing and are still her to tell the tale.

Can an OR tell the bank to hurry the repo along? Wouldn't that be useful if they could....

I don't want to worry you anymore than is necessary, as I am totally aware of how stressful this time can be but I wouldn't rely on your house being repo'd in any hurry.
I've been BR since december, discharged last month, surrendered my house to the bank in January, have missed 9 mortgage payments and they STILL haven't repossessed.
I am in a similar position, local authority won't even consider me for council housing until the house is repo'd.
It is a massive pain in the bottom.
Try not to worry about things that are out of your control, it's a waste of energy, precious energy that you'll need to get through the next weeks and months.

When we gave back our house we had to give the housing benefit proof that we were in arreas with the mortgage and any corespondence we had recieved from the back regarding to repossesion (none, and we still have none even though they have got the house up for sale now!) So all we gave was a letter that said we were in arrears and they were fine with that!

So, what you are saying is that I can prove property is in arrears and will be repo'd at any given time that would satisfy the HB dept that I am entitled to HB?

Do you think that BR will 'strenghthen' my case for this?

I need to ring bank in the meantime I think and say I want to hand back keys....

  • Hey DP,take it easy, FYP is right "one step at a time". You have come this far so not much further to go, Don't go driving when you feel angry, have a drink, smoke instead or something. When you get closer sometimes things start getting jumbled, they did with me. Stay cool Dollparts, keep[ posting;)

On the LHA application, it asks you if you own any property in the UK or elsewhere, that is what I think will make them refuse the claim. I may own it in theory but I'm no longer paying mortgage.

Surely I will have to wait for the repo so my name will no longer be on the mortgage?

I get a small amount of housing benefit and I still technically own my home.
