...I am just annonyed that they have answered my questions incorrectly to stop my benefit and get me back to work. It is quite clear that they are targetting everyone with depression...My depression is very serious. My own doctor is very understanding and helpful, she knows I am not ready to go out and look for a job so why does ATOS think I am? I think it is disgusting that they wrongly answer the questions to get people back to work, they should take peoples illnesses more serious.

Your situation is the norm, the DWP deliberately make false statements to stop paying benefits knowing that in most cases the claimant does not have the personal attributes to fight the system or access to resources such as lawyers which are necessary to protect your entitlement and deal with the complex legal regulations.

Is it thoughAccording to the NAO (National Audit Office) the estimated amount of underpayments by the DWP last year at £1.2 billion pounds.- £900 million was lost in total by claimaint fraud,
- £900 million lost due to "customer error"
- £900 million lost due to mistakes by officials.
Also, most benefit fraud ads / tv shows / press concentrate on the sick, yet fraud rate on Incapacity is 0.5 percent.[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.

Thats right!..Before any court case/tribunual/even appeal.....you have to make 2 copys and send the originals by recorded delivery to the judge or presinding officer,...one of sets of copys have to be sent to the defence, also by recorded delivery,Child of a Fighting Race.0 -

If it was something in the bundle, how would he know if it was in the tribunals copy of the bundle? Documents can be in one, but not the other.
How would he know if the judge or chair had raised the issue of any missing documents?
Its possible that documents could go missing from either bundle, its even possible the trbunal may fail to raise the fact of missing evidence in their bundle. In fact, its even happened at a second appeal, where a commissioner had multiple documents missing from his bundle (and pages in the wrong order also) - yet he didn't raise the issue and request the documents - he proceeded with the hearing anyway, despite the missing evidence.
"This task is not made easier by the fact that a few of the material documents are missing from the bundle before me and those that are there are not always in chronological order, but I am fairly confident that I have managed to piece together what has happened."
