Littlewoods am I doing this right?

just need a bit of support on this, I need to know that I am doing it right? Littlewoods, late payments fee = £386, I wrote to them for statements, and ask for a refund, they said no, TWO years later out of the blue I get a letter from a Solicitor and a court order!!..ok filled in form asking for 28 days, and also that I would be defending the case (counterclaim) requested a letter from Job seekers stating I was unemployed (I have been made redundant) so that I could claim on the fees, OK.received letter to day from Job seekers, so now I can fill in the form I picked up from the Court asking for fee for Counterclaim to be paid for me, also received another letter today from Solictors today, saying, please ring us asp to discuss this payment, please take it seriously, you may wish to take legal advise, its not to late etc..
Now I am going to fill in the court form telling them why I am defencing these late payments (unlawful fees) and send it of..now question is....do I ring the Solicitors and tell them, or write to say, leave me alone the courts are now dealing with it? just a bit cross that they are trying to pressure me...the man at the court where I went to for advise on filling the forms in, said they do this hopeing you will panic and just admit to the claim, as it easier, and to get them of your back, but of course you then have to find the money each month to pay it back each month....I don't see why I should pay back unlawful charges, I am hopeing that once the Company has received my counterclaim they will just drop it, because now if they don't they will have to explain to the court why they are charging £12 or £5 a time for a late payment charge...hope I am doing it right, can you tell me that I am, do I tell the solicitors, thus making them aware of what I am up to. they have also added there fees and court cost plus 8% interest total of £467.44..sorry its so long......;)Lilly

The court will inform the claimant of your acknowledgement and counterclaim, there is no requirement for you to do so.0

Thank you very much for your answer, it seems that I am doing it right then:rolleyes:.....I am hopeing that I won't actually go to court, as Littleswoods will have to give a breakdown of their charges, which from what I have read they don't want to do...if I do have to, I guess I just say to the Judge,'I would like the Company to explain their costs?, is that right?...;)Lilly0

Same as me, I have spent hours looking for help or a success with Little woods, and haven't found any, but as I said before, the man at the Court (who I was asking advise from) said they do this to scare you into paying, and why should you pay, these fees are unlawful...so I am going to try and push this claim to the limit, at the worst I will have to pay it back, but if and when I win!, it will help so many other people, as Littleswoods really don't want to explain their charges, do they?, This case might well open up a flood gate for us, maybe no one has gone this far in trying to claim back...I am sure we would have read somewhere, if Littlewoods had won a case...and I haven't!! , but they have really given me a hard time, I did feel at times that it would be easier to pay it back, but that court order really put my back up, how dare they!!! so now it pay back time...haha...will update as I go along, I think a few people will be watching this thread to see what happens.....;)Lilly0
