Need some info if poss re 90 day notice period

My DH was made redundant with 1 hours notice in December 2008, along with 120 others.

He claimed JSA for 26 weeks and in now getting nada due to me working full-time.

The ex workers are going through the legal system to get the 90 day notice money they are legally entitled to. The case was heard on Monday of this week, with no outcome as yet.

He's been informed (probably wrongly) that out of any monies he gets paid, he will have to pay back the 26 weeks JSA he's had.

I can't see that myself, but knowing the state of this country at the moment it so wouldn't surprise me!! :mad:

Has anyone any info on this?

    I have no background at all but sounds sensible to me. If he had got what he was entitled to at the time he wouldn't have received the JSA so it seems like the government would be entitled to claw it back, as annoying as that is.
  • No he wouldn't have to pay it back. Unless your DH hadn't been working for very long, he would have been claiming "contribution based" JSA which is purely based on class 1 NI contributions in the appropriate tax year and does not take any savings or partner's income etc into account.

    You would be right if the issue were about savings but I don't think it is.

    What is at issue is that if the 90 days notice had been paid, it is likely that the JSA would not have been paid for those 3 months. However, ....

    If the start of the CB JSA had been delayed for those 90 days, then he would have begun signing on that much later and his JSA would continue to run for 26 weeks from then. That would mean it would be 90 days beyond the original end date. If he is unfortunate and doesn't get a job to start in that "extra" time then, IMO, he would be no worse off.
