Please help! I purchased a t shirt about 6 weeks ago as a present and this was paid for in cash. I noticed while wrapping it that there was a hole consistent with security tag. The House of fraser store were very unhelpful when I returned to them with the item and the price tag still intact and said their policy was not to give credit notes for faulty goods without a receipt, which unfortunately I cannot find. I have written to their Head Office regarding the Trading Standards Act 1979, which I was advised to do, however I feel this is a waste of time, as the manager at my local branch has advised that they will only forward letter back to her and she cannot assist me.
please tell me, do I have any rights?

I work in Dorothy Perkins and we are told, with or without proof of purchase, you have to by law give a refund... in which tender is to retailers descretion but you have to offer at least some kind of compensation because, its a faulty item, although, it is only if this appears as a genuine manufacturing fault. With regards to a security tag hole, this is still a fault, by error made by a member of staff (who are all taught to tag through the seams by the way to avoid instances like this occuring) All stores have a customer services number they can phone and be advised about faulty items and i garentee you, 9/10 times u will be offered a sincere appology and a full cash refund. Also if you return to the store you bought it from, they have what is called a journal, and if you can remember what you bought and the date you bought it they can trace ur transaction and print you off basically a new receipt.
Take it as far as you possibly can, you have rights... remember in retail... the policy is... "the customer is always right..."Never regret anything that made you smile0 -

if she went back to the store she bought it from they can produce a receipt from their journal, don't be so judgemental. Accidents happen. Nobody keeps every receipt. She has rights with or without a receipt.Never regret anything that made you smile0 -

Sorry But I can see your point but I was not asking for a refund, but a creit note to spend in their store.0 -
I don't think he's implying the OP stole it, but me she bought it from they can produce a receipt from their journal, don't be so judgemental. Accidents happen. Nobody keeps every receipt. She has rights with or withouerely saying that there's a few reasons as to why the shop is reluctant to refund.
OP needs to find that receipt - surely if it's a gift you keep the receipt in case the recepient didn't like it or it didn't fit?Squirrel!If I tell you who I work for, I'm not allowed to help you. Just to clarify: Without some form of proof of purchase, you have NO legal right to a refund, exchange or credit note. Also, the onus is on the BUYER to provide proof of purchase, the retailer does NOT have to provide this information...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands
