As long as the will hasn't specified the solicitor as executor there is no reason at all not to do this - your solicitor is just being awkward/is miffed he won't get as much in fees. Find another one.
A STEP practitioner (google for it) is probably best.
Very sorry to hear of your loss. Very easy to do it yourself if a straightforward estate. I've done it twice. One word of warning though. If your mum had any pension credit paid, then the Department of Works & Pensons may ask to investigate/check the estate after PROBATE has been granted. So, don't distrubute/spend the money before they have confirmed they are happy. I had a relative who I did the probate, 3 months later Dept of Works & Pensions wrote to have evidence of original bank accounts/etc/etc. All was well and I didnt have to pay any money back from the estate, but you are personally liable if you are executor and they want some money back from the estate, so just make sure.
