You know sometimes MH we say what we think the "others" want to hear(and i have been guilty of doing the exact same thing)on here but then after a while you think." bu@@at them i will say what i feel/think...what is the worst "they" can do......not press the thanks button, dissagree. who cares the most importent thing is we are here to help in whatever way we can, even if that means going against what some here feel is the not the way forward. I think the recent "congrats" thread has done damage but then those sort of threads always do.

• Hi Sammy,

How are you doing? Just a couple of quick questions? Is the car on Hp or bought outright?

Also, I think you mentioned that you often use a taxi to get your son to hosp when your hubby has the car. You could advised the OR that you use the car for his appointments and that it is needed for this purpose then there shouldn't be no reason why you can't keep it. Also have you done a recent valuation on Parkers Guide? This is the guide the OR's usually use to get a rough idea of vehicle valuations.

Good luck & chin up.x

Hi Miss Spooky
Thank you for your support. Car is owned outright, we paid £4995.00 for it in Feb 09, after swapping a 06 plate VW Passat, for this one, so we gained £2,000.00 :) Were suffering money wise at the time, so needed to do this.

Did a valuation on Parker's can't remember what it came back at now, something like £3,800, so I believe more than OR will allow.

Again thank you :)
• Hi,

The value of your car is certainly higher than OR would usually allow. I assume it hasn't been modified in any way for your son? If you can make an argument that it's essential to get him to appointments it's still not guaranteed to be safe...it really depends on the individual OR. For example, they may agree that it's essential but may feel the value is too high. One outcome may be that they do take the car but they release a small amount for you to buy a cheaper runabout.

I'm not saying this will definitely happen but it's fairly common.

They may also ask you to account for what you did with the £2k you gained from selling your previous car. It's to check that you haven't treated any creditors at a preference.

Good luck!

To be fair, the £2,000.00 was to up the bank balance, as OR will see, as we were about at £0.00 in the bank then, lol. (At this stage we wern't getting DLA for our son)

I am hoping they allow a cheap run-about for him, or let him keep the car we've got, he travels 48 miles a day work and back, so surely they've got to allow something, but then again they may not....Really don't know!?

im led to believe your not declined bankruptcy???

doesnt the OR just up your monthly payments if you have big disposable income

although I personally think £500 is nothing.

Ive spent 250 quid in the last week on stuff I wasnt expecting like vets, car etc

im led to believe your not declined bankruptcy??? Under the Insolvency Regs you have to be 'insolvent' to declare yourself bankrupt. The definition of insolvency is that you can't pay your debts as they fall due. This isn't something the OR would look at in any case as they don't get involved until after a district judge has made the bankruptcy order at court. It would be up to the judge to decline to declare you bankrupt at this point if they felt you weren't insolvent or that a fast track IVA would be a better option for the creditors.

doesnt the OR just up your monthly payments if you have big disposable income The OR can ask for IPA or get IPO for 50-70% of your disposable income. But if they think any of your expenses are too high they can effectively disallow them by inflating the surplus and increasing IPA/IPO ( e.g. if they think a rented property at 600pm is expensive for an area or too big they could just decide to allow £450 for rent. Then you would have to either make the shortfall up by cutting something else out or move to a cheaper property. This is just an example, I'm not saying it will always happen

although I personally think £500 is nothing.

Ive spent 250 quid in the last week on stuff I wasnt expecting like vets, car etc

The budget does allow so much per month for emergencies

doesnt the OR just up your monthly payments if you have big disposable income Both the BR and the OR will agree on a % of your surplus for 3yrs the OR simply wont up payments without discussing with you 1st..

although I personally think £500 is nothing. Well i'd like it if its going free
