Hi any advice please

Hi Im in a bit of a fix as I am unable to do my job as I need a car and my car is kaput I cant afford to get it fixed or to buy another one so I havent been at work for the last three weeks so im not earning anything I rent a house my daughter who has just finished uni lives with me she has started a part time job this week there is no other income coming in so my question is am I able to claim any benefits at all any advice would be greatly appreciated

  • no sorry I didnt explain I vist people in their own homes i am a care and support worker so cant do my job without transport and no riding a bike would be no good either but thanks for your helpful reply

    i assume that you are on leave or sick from work, surely they dont jsut let you sit at home and keep your job for you??
  • Can you not talk to your employer and ask for a solution such as a loan?
  • no Im not on leave or off sick and yes at the moment my employer is keeping my job open and no cannot ask for a loan its their policy not to give staff advances so back to my original question am I entitled to any benefits ? and if I leave my job for the above reason will I be able to claim unemployment benefit

    Hmm, tricky one. If you are not being paid and are working zero hours then I would think you would satisfy the remunerative work rule.

    So the next question is one of availability - are you available for other employment, albeit of a temporary nature until you can return to your 'normal' employment?

    Regarding leaving the job, you are unable to perform your duties currently so, providing you take every possible step to enable you to perform those duties, you maybe able to show just cause for leaving. However, the fact that your employer is currently keeping your job open for you would make this very, very difficult indeed.

    A person working 16 hours or more per week is considered to be in remunerative work and not entitled to Jobseeker's Allowance.

    If I were in your position, I would not leave my job but would still claim JSA - the rules can be very complex and the only way to really find out is to make the claim.
