    Thanks. Regarding the severe disability element...i neither want it nor do i expect to be eligible for it, indeed i never applied for it...it was offered erroneously. Hopefully when i contact them they will remove this but leave the disabled element intact.

    In what way ?, you can challenge them with regards to the tax credit legislation which states specifically that only the care component applies to the Severe Disability Element.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    I think i'm failing to be understood by you. I'm not challenging the award of the severe disability element because i'm not claiming it...i didn't claim it to start with.

    do both people in a couple have to be working to claim a disability element ??
    my husband works 30+ hours aweek and i am disabled claiming incapacity benefit ??

    The additional Disability Element relates to the working member of a claim.....or any/all child(ren) with disabilities.

    If TCO are have included the severe disability element in your award in error and you are aware of it (as you would when you read your award notices) then if you fail to contact the TCO to correct the error and continue to keep taxpayers money to which you aren't entitled then an overpayment may occur which you will have to pay it back.

    To quote their standard response in a dispute case - "the award notices ask you to check all details are correct and notify them immediately of any errors".
