ebay/paypal dispute advice

I purchased a cd for 8.5 euro
It arrived sealed but the case was obviously old and broken inseveral places
but more importantly there was NO cd inside.
The seller said he had purchased them from a shop and had no copies left
he was sorry and would refund me.He has not done so despite sending another email saying he would.

This is now a dispute but the advice I have received from paypal is that

"In order to proceed with our investigation of your appeal, we request that
you report the damage, alteration, or missing parts regarding your returned
merchandise to your local law enforcement agency and supply PayPal with a
copy of the report. The report must be on headed police paper and stamped."


What am I supposed to do here?

    What dispute did you open. Was it Item significantly not as described? because if you had done that and escalated paypal would just ask you to return for a full refund. They do have some strange automated messages at times it sounds like some wires have got crossed at some point. If you can clarify what the claim is for then we may be able to help with the best way to proceed

    I think you need to contact them and say that you have opened a dispute as item not as described and that they are now asking for police reports which is inappropriate as you have not stated that there was anything that needed reporting to the police and that all your are claiming is that the item is not as the seller described.
  • Paypal efficiency strikes again - maybe if they were regulated by the FSA like all other financial institutions in this country then issues like this would stop (or at least not be SO prevalent)

    I phoned back and they are repeating the same mantra
    about me supposedly vsiting the police.
    Am I supposed to take an empty cd case to the police and ask them to
    say its empty.
    I have no intention of doing this its absurd.
    The seller an Italian meanwhile has provided some light relief by resorting to some
    flowery language in his responses.
    "ASSOLUTAMENTE UN ROMPICOGLIONI (COME AL SOLITO DEL RESTO)GRAZIE ....TROPPI PSICOPATICI SU EBAY"
    Rompicoglioni translating as ***holes.
