    I really do not think you should be sending a message about this without some legal advice. Have you spoken to a solicitor? i suggest you really do need a cheap or free half hour appointment.

    I would add something like

    "I have been trying hard to arrange a loan to cove the repayment within the timescale.

    Unfortunately, the bank will not authorise this and since I do not start my new employment until... my options are very limited."

    Do not put in the bit about the police.

    Do not suggest that you will pay £170 but pay more if they want it. They want it already.

    You might suggest that they accept that payment in the first instance and that once you have been in employment for 6 months, you will attempt to obtain a loan to cover the remaining debt?

    I cant see them accepting the £170 as a long-term option, can you?

    Thanks everyone, I think I may take out the higher payments all together as it would really stretch me. I just want to try and get across how much I want to avoid them taking this further and pretty much how desperate I am. Just not very good at getting it across in an email!

    The whole situation has been handled very casually, or more so then I thought. I'm hesitant about legal advice as I suppose in one way thats like admitting I'm going to be arrested and I don't want to face that - not yet. I know I probably sound naive, but if this goes to the police and the legal route then everything is over for me.

    Time after time when I have spoken to my hr manager, she has been supportive and understanding, she has sent me pages and pages of debt management info and at the same time I think they know the chance of me being able to pay this off in one lump sum are slim to none. They are aware I have a new job and have had for a month, thats why I am offering payments for 6 months which I would have said is short term.

    Do you not think this is advisable then?

    I think you really should talk to a lawyer before you send the e-mail. There may be odd turns of phrase that make you situation worse and you do not understand.

    Trying not to go back over old ground but is there really nothing you can sell? Do you have a car, tv, sound system, house? Perhaps you could borrow a little bit off several family members?

    I know 5k is a lot of money (and I would really struggle to raise it) but perhaps a lump sum of 1 or 2K that you have begged/borrowed/sold something for followed by an installments option would make you look more willing.

    I really don't think you should turn around to them now and not even have a small payment to put against it.

    Just my opinion from the other side.

    I know where your coming from but I live at home with my parents who have just taken on a new house with huge mortgage. My mum has no cc,loans etc and is under pay plan and unable to obtain credit, my step dad is my only option but he has only agreed to co-sign a loan for me as he isn't in a good position himself.

    I have nothing I can sell, i spent all day yesterday going through everything and short of selling my clothes - of which i have little, its nots going to happen. I'm backed into this corner, and I know its my own fault, and i don't see anyway of getting out of it. I've totally screwed up my life, I have nightmares on a regular basis that the police will show up at anytime and arrest me, my whole career rests on this not going to the police. I'm at a loss as to what to do.

    Heres another thought, why not call ACAS who specialise in employment law and disputes, they may be able to give you some advice on this, I think the email looks fine but you should only offer what you can realistically afford, have you done a budget and checked you can afford this. Also are you getting some help with your gambling and other debts?
