Hi, not sure if i'm posting in the right place but here it goes....

I'm in the process of trying to claim back for PPI and insurances with WCF. I was advised by others in a similar situation to send off a CCA request and write a letter of complaint about my PPI.

I did this and recieved the credit agreement through the post, special delivery. I've compared it to the original agreement I already had and to my shock there's a couple of differences:
  • Firstly the signatures don't match at all, different positioning, letter formation etc.
  • The tick boxes for the insurances are not ticked in my version...in their version they are.
  • My version is not signed nor dated by WCF, their version is.
Could someone please tell me if i'm right in thinking that there is only 1 original signed credit agreement and that both welcome and I should have identical copies of this?

If this is the case, that is NOT my signature, and that is NOT the agreement that I signed. Where do I stand legally with this? Surely this is fraud on their part?

I'm guessing that they no longer have my agreement and made this one upon my request?

Please help, It angers me so much to think that they get away with this kind of behaviour.

    At the time of signing the agreement, there should have been 3 copies of the contract. One is a Pre Contract, which contains all information the other copies do, but has no space for a signature. You should have been given this. Then there is a Customer Copy and an Original. Both identical, except the customer copy states 'FOR YOUR INFORMATION ONLY' somewhere on it. WFS often retain the wrong agreement and if they retained the customer copy, it is not a binding legal agreement. Only the version WFS have should be signed by you both, as that is the original. Is it a carbon copy? If so, sometimes this can affect the way a signature looks, however, a tick in the PPI box should still be evident. I would write back to WFS, enclosing a copy of both contracts and ask for an explanation as to to why two agreements have been issued with differing information. I don't believe they would have made one up now, to be sure, you will be able to tell if its been printed from an archive system, as there may be some numbers along the top/bottom of the page. Also, depending on when you took it out, post 2004 (ish) you should have been issued with a Demands and Needs document, so make sure you have a copy and that the info on your circumstances is correct.
