FOS Adjudication - LTSB

Hey,
Looking for a bit of advice again! This one has been ongoing with LTSB for well over a year and has been with the FOS since Feb 09.
My complaint is relatively complex and covers a number of issues. I've recieved an adjudication from the FOS basically saying that LTSB have done everything they should have and that I need to wait until the outcome of the Test Case in relation to my charges. My point has always been that the charges are a side issue, despite an acknowledgement i'm in hardship, but the other service failings and handling of the my case / complaints were far from acceptable.
Is there a tactful, polite way of telling the FOS that i'm not happy and feel that they've missed the point of my complaints and objections.?
It all stems from mis-sold LPI which never paid out (2003), a poorly consolidated refinance loan then excessive charges winding up with hardship on my part and then coupled with poor communication within LTSB and a blatent disregard for my circumstances. I'm at my witts end, dont know what to do other than give up, but deep down feel that it might be worth one last push...has anyone else been this far down the road with the FOS? and what did you do?

LTSB paid out over £3K on the LPI, this is more about dealing with the FOS when they have issued an adjudication

Please see the above and we will see what has happened, hopefully how it has happened, what the FOS have adjudicated on and most importantly if we can do anything further. This may take a few days because of trying to get an idea how to deal with this one. OK?Hey,

I think you need to separate issues out to be honest and let's see where it leaves us.
I've recieved an adjudication from the FOS basically saying that LTSB have done everything they should have and that I need to wait until the outcome of the Test Case in relation to my charges. With Bank Charges the FOS will only adjudicate on financial hardship, Whether they did not write at the time you wanted them to or didn't send out and income and expenditure form(which they are not required to do) may not necessarily mean that you have suffered a financial loss so I guess we have to look at that issue.

Have they now paid out this one? Did you ask them to do so? and when did they pay out?

Financial Hardship as defined by the waiver is being interpreted as priority debt arrears(ie rent/mortgage, council tax, utilities).

What do you mean by poor communication and how did you communicate with them? Was it in writing or verbally? How did they disregard your circumstances?

Cheers...I'll try to form a succinct breakdown. The paper file of letters between LTSB and I and then the FOS is about an inch thick! The FOS have adjudicated that the bank has dealt with me in regards to my hardship just not by refunding my charges! I'll draft a fuller response and post later cos it's going to take some time!
