Insurance Claim?

Hi there,
Over the past weekend, my 'soil' drain collapsed resulting in toilet soil coming from below my kitchen step.
Basically the cast iron drain pipe which comes from the toilet to the drain, had a concrete step built around it...
This needed to be removed to get to the drain below...
So the drain is replaced but I have no step and broken paving...
I originally claimed on my Emergency Home Cover through ESure which is apparantly with HomeServe.... there was no excess.
I have called eSure to repair step and paving and they have informed me that on my normal building insurance I have a £600 excess which I don't remember opting for.... but anyway....
What insurance should pay for this? The Emergency one which caused the damage or my normal insurance?

As you have claimed for the repair, I would say the ones who repaired the soil pipe and damaged your step are liable. But I'll bet they got you to sign some kind of waiver that says they aren't responsible for fixing anything but the original fault. If thats the case, then you could still try and get them to pay for the step to be fixed, or pay someone yourself. Better still go down to Wickes buy a bag of concrete and a bit of plywood and cast yourself a new step!0
