    Hi,
    I have no problems with RM/PF holding the goods before payment at all - it's the legally written way things should be done.

    The solution is for RM/PF to have the monopoly of British postal deliveries. British jobs for British workers and all that! I'm really annoyed that a foreign-owned company is trying to muscle in and manipulate guidelines.

    Failing any monopoly, then guidelines/legislation should be changed to encompass foreign-owned carriers to do the job and claim the fees - at present they are not included.

    All that I have to say on the situation is that rules should be complied with and not manipulated.

    I didn't understand where the OP was coming from initially.

    I have always felt that couriers think of a number and double it and therefore ask for items to be sent by airmail if possible.

    As I see it you have the goods (which makes life easier) and should spens a bit of time writing a letter to Fedex highlighting their mistake and detailing the HMRC guidlines and inviting them to take you to the small claims court should they not agree.

    My other question do you know for sure that the item was actually presented to HMRC do Fedex have a receipt/chit or whatever form they use?

    Now I may well be wrong but I thought a gift through customs only could be sent by a family member or relative?

    They take a dim view if for example you bought a item via ebay from a seller in lets say the US and it was marked as a gift and they found out!

    To qualify as a gift:
    - the customs declaration must be completed correctly
    - the gift must be sent from a private person outside the EU to a private person(s) in this country
    - there is no commercial or trade element and the gift has not been paid for either directly or indirectly
    - the gift is of an occasional nature only, for example, for a birthday or anniversary.

    In your example, fiddiwebb, it yould fail on both the 2nd & 3rd points.
  • I am bracing myself for such a bill arriving too, which is why I found this webpage. I used to read about it on the web several years ago (it could well be a rumour spreaded by FedEx employees!) that when FedEx deal with your imported goods you aren't charged VAT as FedEx pays for it. I can see that it is definite not true!

    If it's any consolation to the original poster, the equivalent charge by Royal Mail is £8 plus the VAT you're liable to pay. So you're effectively already saving £1.20. Also the VAT they charged you is under 10% - as you know the current VAT is 15% so it's really not that bad.
