Faulty item --- in or out of warranty

    Following this thread with interest.

    My dd's Nintendo DS stopped has just stopped working. It was purchased in December 2008. I still have the receipt. Wondering if it's worth boxing it all up in the original packaging & taking it to the retailer for....I don't know what!

    Will they refund? Exchange? Send off for repair at their own expense? Or what I fear is more likely, just shrug their shoulders & say, "Computer says naaahhhhhh".:confused:
  • Thanks Scooter, I should have said I have posted this on the consumer rights board and been advised I am unlikely to get a result trying to use SOGA so I am going to grit my teeth, throw it in the bin and try not to think about it again. Just so you know I have phoned around and cannot find anyone to repair it except sony who want a flat fee of £167 - it only cost £152 originally so there's no wonder landfills are chocco.

    You are within the 1 year manufacturers warranty period so what exactly is the problem???? They will send it to nintendo or contact nintendo directly and they will arrange the repair/replacement
  • UPDATE: Graco still claim it is out of warranty, and fail to reply to my point of 'fit for purpose for an expected period of time', is there any further recource I can take my case? Could be going round in circles if I write back again!

    hungry have you tried calling consumer direct? I had a silver cross buggy that after 7 months developed a fault in the hood, all i wanted was a repair or replacement hood, but silver cross had stopped that colour so had no spares!! I contacted consumer direct who told me what to say, and i called the store i purchased it from and was given a FULL refund on the buggy and all accesories! I was chuffed to bits, and went out to choose a new buggy... well worth a call!

    There is no problem(so far), just wanted to know where the land lies.

    So, WH Smith will sort it all out at no cost to me whatsoever?

    To go back to the original question...
    There seems to be confusion about the length of warranty Argos offers on electrical goods.
    Some people are told 12 months.
    Some people quote the EU directive and get things exchanged up to 24 months.
    Some stores incredibly take things back up to five years.
    I have done a search on the Argos website and can find no information about the warranty they offer on electrical goods.
    There seems to be no basis for Argos staff saying that they cannot replace items over 12 months old as if it is company policy.
    The Sale of Goods Acts states that goods must be replaced if they fail within a reasonable period of time. The reasonable period of time depends on the sort of item and the price paid. Therefore each item must be considered separately by the retailer.
    So why do staff at so many retailers come out with this 12 month rule? Are the staff trained to say that? As I said above, the retailers with not put this rule in writing because they know it is incorrect.
