It is because the OFT test case is kinda back to front so to speak. The OFT test case should really have gone to court on the terms being fair or unfair rather than whether the OFT can assess the terms for fairness. That means that once the HoL have gone with their judgement and if the OFT wins that the next process of identifying and litigating on the fairness issue can start. The Banks' may be prevented from making charges at that point via an injunction while the terms are decided on fairness. The claims will not be lifted until ALL issues are decided including can the OFT assess for fairness, which terms are unfair, possibly even price that can be charged, and if refunds are to be given, how far that they should go back to.
As the terms are still classed as Fair then the banks have the right to levy bank charges.0
